Your Chapter 7 Bankruptcy case is an ongoing matter. As you attorney, I will keep you informed about deadlines or events. I have made this Chapter 7 Information page to give you an overview of your case.
Attend your 341 Meeting of Creditors.
This is one of the first things you will do after your case is filed. This is a meeting conducted by the trustee’s office. You may be assigned to one of several Chapter 7 trustees. You have already provided pay stubs and tax returns to me. I have forwarded this to the trustee. I still need your bank statements showing the balance as of the date of filing. Send those to my office before the Meeting of Creditors.
Take your Financial Management Class.
As we discussed, you have to take two classes when you file a Chapter 7 case. Before you filed, you took a class. Now you must take the financial management class. While you have many options, I recommend www.10debtoreducation.com. This class is required to get a bankruptcy discharge.
Sign any Reaffirmation Agreements.
Unlike other pieces of Chapter 7 Information, this one may not apply to you. If you have a car that you are making payments on, you can choose to reaffirm that date. I have written a blog post about reaffirming. Remember, that you are not required to reaffirm a debt. If you cannot afford the payments, reaffirming in a Chapter 7 Bankruptcy is a bad idea. Make your mortgage and car payments.
Another piece of important Chapter 7 Information concerns your ongoing car and house payments. If you are keeping these things, you should pay them. If you are planning to give them up, don’t pay the regular payments. You should keep your property insured until you give it back to your lender. For a house, it may take months or years for the bank to take control. In these situations, the Chapter 7 Bankruptcy does not relieve you of your obligation to keep the property nice and up to code.
