How much does it cost to file bankruptcy in St. Louis?

The cost to file bankruptcy in St. Louis will largely depend on whether you file for Chapter 7 Bankruptcy or Chapter 13 Bankruptcy.  Additional, the Chapter 7 or Chapter 13 Bankruptcy attorney you choose will have discretion over certain fees he or she may charge you.

Firstly, you must realize that the cost to file bankruptcy in St. Louis has multiple components.  The U.S. Bankruptcy Court will charge a filing fee when you file your Chapter 7 or Chapter 13 Bankruptcy case.  For a Chapter 7 case, the filing fee is $306, and for a Chapter 13 case, the fee is $281.

For a Chapter 7 case, the attorney fee portion of the cost to file bankruptcy in St. Louis will vary depending on what attorney you choose.  In this area, you will see fees that are around $900 to $1000 for the attorney fee (remember – this does NOT include the filing fee we already discussed).  The bankruptcy attorney you choose has discretion over this fee. A bankruptcy attorney can charge based on how complex the case is, among other factors.  Expect a normal St. Louis Bankruptcy attorney to charge you around $1500 or more total to file the case.  This will include the filing fee and other costs.

For a Chapter 13 case, the attorney fee portion of the cost to file bankruptcy is set by the United States Bankruptcy court in this district.  Currently, in the Eastern District of Missouri, the flat-fee is $4000.  The bankruptcy attorney you choose has discretion on how much of this fee to charge up front (which is usually between $500 and $1000).  The rest of the fee will be paid through your Chapter 13 Bankruptcy repayment plan.

The bankruptcy attorney you choose may charge you for another cost to file bankruptcy in St. Louis.  This may include pulling a credit report or the cost of the credit counseling class you have to take online.  The typical cost of having your bankruptcy attorney obtain a credit report is around $20.  The cost of the credit counseling class is usually around $30, but can vary quite a bit.
